Prince Harry has finally received happy news after years of living under threat as lawyer reveals he is safe in the US.
Donald Trump’s plans to deport him have fizzled out as immigration lawyer confirms the US President doesn’t have the power to kick the Duke of Sussex out.
As per Radar Online, immigration lawyer Flomy Javier Diza stated Trump cannot just throw Harry out of the country despite accusations of lying on his visa papers.
The Heritage Foundation’s lawsuit seeking to release Harry’s immigration papers is ongoing, but expert said that deportation would require a valid legal basis, not just political rhetoric.
“President Donald Trump does not have unilateral authority to deport an individual, including Prince Harry, who is a lawful permanent resident of the United States,” Diza said.
The lawyer continued, “Any deportation would require a valid legal basis under U.S. immigration law, not political rhetoric.”
“Removal or deportation in the United States is governed by statute, not by presidential preference,” Diza explained. “Even a sitting president cannot personally order the removal of a specific individual.”
King Charles’ son would be “deportable” would be if the U.S. government were somehow able to “show that he is legally removable under the Immigration and Nationality Act,” which includes “immigration fraud, misrepresentation, certain criminal convictions, or violations of visa or status conditions,” she noted.
“Public speculation, such as admissions in a memoir or media interviews, does not automatically translate into deportability unless it directly establishes a statutory ground and is supported by admissible evidence.”
